1. Acceptance

By accessing or using mt5depot.com ("the Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service. Your continued use following any update constitutes acceptance of the revised Terms.

2. Operator

The Service is operated by Attempia Limited, a company incorporated under the laws of the Republic of Seychelles (International Business Company) ("we", "us", "our"). We are not a licensed financial adviser, broker, fund manager, or investment firm in any jurisdiction.

3. Restricted Jurisdictions

The Service is operated under a passive-solicitation regulatory model. The Service is not directed at, and may not be used by, residents or nationals of any Restricted Jurisdiction.

The Restricted Jurisdictions are those set out on our Restricted Jurisdictions page, together with the regulatory reason for each. That page forms part of these Terms and is the single authoritative list; it is maintained there so that the list and its reasons cannot drift apart. The list may be updated as regulatory environments change, and the version in force at the time you use the Service applies.

By using the Service you represent that you are not a resident or national of any Restricted Jurisdiction.

4. No Financial Advice

Nothing on the Service constitutes investment advice, financial advice, trading advice, or any other form of advice. All content is for informational and educational purposes only. Past performance of any Expert Advisor or strategy is not indicative of future results. You should seek independent financial advice before making any investment decision.

5. Expert Advisors — Licence and Use

EAs distributed via the Service are provided on a royalty-free, non-exclusive basis for personal use. You may not resell, sublicence, or commercially distribute any EA obtained from this Service. The EA files are provided "as is" without warranty of any kind.

This Section applies only to EAs we distribute. It does not restrict code you create with the Builder, which you own outright and may sell or redistribute under Section 8.

6. User Submissions (Free EA Pool)

If you choose to share an Expert Advisor, indicator, or other file (a "Submission") to the mt5depot public pool, the following terms apply in addition to the rest of these Terms.

• Your warranties: You represent that you own or have the right to distribute the Submission, that it does not infringe any third party's intellectual property or other rights, and that it contains no malicious code, hidden transmission of account data, or undisclosed external connections.
• Licence you grant: You grant us a worldwide, royalty-free, non-exclusive licence to host, store, display, distribute, and make the Submission available for download to other users for as long as it remains in the pool. You retain ownership of your Submission.
• Anonymity: Submissions to the pool are published without attribution to the author unless you request otherwise.
• Your responsibility: You are solely responsible for your Submission. All Submissions are distributed "as is"; neither we nor downloading users assume any liability for losses arising from any Submission.
• Our rights: We may review, reject, edit the metadata of, or remove any Submission at any time, with or without notice, at our sole discretion — including for suspected malware, infringement, misrepresented performance, or any breach of these Terms. Listing a Submission does not constitute endorsement or verification of its performance unless it is explicitly marked as Verified.

If you hold rights in material published in the pool and want it taken down, Section 16 sets out how to send a notice and how we respond.

7. mt5depot Builder — Free Tier and Paid Licence

mt5depot Builder is a browser-based, no-code tool that generates MQL5 source code. It does not place trades, connect to a broker, or provide investment advice.

• Free tier. Designing a strategy and compiling it to a ready-to-run file is free of charge. No payment is required to use the Builder.
• Paid licence. A paid licence is sold as a one-time purchase and does not expire. It adds the editable MQL5 source code — the downloadable .mq5 file and the full generated source in the Builder's Code tab. Current pricing and the exact feature difference are shown on the pricing page.
• Personal to your account. A licence is granted to you and is tied to your mt5depot account. You may not share, resell, or transfer the licence or your account credentials. This restriction applies to the licence itself — it does not restrict the code you generate, which is governed by Section 8.
• No guarantee of results. The Builder generates code from the blocks and templates you select. We do not warrant that any generated strategy will be profitable or suitable for any market, broker, or account.

8. Code You Generate

This Section governs the MQL5 source code and compiled files you produce with the Builder ("Generated Code"), including files produced on the free tier.

• Ownership passes to you. We claim no ownership of your Generated Code. To the extent that any rights in it would otherwise vest in us, we assign those rights to you.
• Unrestricted use. You may use, modify, compile, publish, sell, sublicence, and redistribute your Generated Code, for personal or commercial purposes, including delivering it to your own clients. No royalty, fee, or attribution to mt5depot is required.
• Survives termination. Your rights in Generated Code produced before any termination of your account or licence continue indefinitely. Nothing in Section 14 affects them.
• Non-exclusive by nature. The Builder assembles code from shared blocks and templates. Other users who select the same blocks may generate substantially similar code, and we may generate similar code ourselves. You therefore receive full freedom to use what you generated, but no exclusive right over the underlying patterns.
• The Builder itself is not included. The Builder's interface, templates, block implementations, code-generation engine, and documentation remain our property. You may not copy, decompile, or reimplement the Builder, or use it to operate a competing code-generation service.
• Your responsibility. You are responsible for reviewing, testing, and validating Generated Code before using it on any account, and for complying with the rules of any platform, broker, or marketplace where you deploy or sell it.

9. Payment, Immediate Access, and Refunds

• Prices and processing. Prices are shown on the pricing page in US dollars and are the total amount you pay — nothing is added at checkout. Payments are processed by PayPal. mt5depot is the seller of record and issues receipts. Where consumption tax or VAT applies to your purchase, it is included in the price shown.
• One-time purchase. A Builder licence is charged once. There is no recurring billing and nothing to cancel.
• Immediate access and right of withdrawal. Paid features are activated on your account immediately after payment. At checkout you expressly request that immediate access and acknowledge that you lose any statutory right of withdrawal or cooling-off period once activation occurs, as permitted for digital content supplied with your prior consent under EU and UK consumer law. If you do not wish to give up that right, use the free tier instead of purchasing.
• Refunds. Refunds are governed by our Refund Policy, which forms part of these Terms.

10. Affiliate Relationships

mt5depot participates in introducing-broker (IB) programmes with brokers listed on this site. We may receive compensation when you open an account via our links. This does not affect the editorial independence of our reviews. See our Affiliate Disclosure for full details.

11. Intellectual Property

All site content, branding, and software (excluding third-party MT5 EAs where credited) is owned by or licenced to us. MetaTrader 5 and MT5 are trademarks of MetaQuotes Software Corp. mt5depot is not affiliated with MetaQuotes Software Corp.

This Section does not apply to Generated Code, which is governed by Section 8.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no representations or warranties of any kind, express or implied, as to the accuracy, completeness, or fitness for a particular purpose of any content, EA, or Generated Code obtained through the Service.

13. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Service, any EA downloaded from it, or any Generated Code, including any trading losses.

14. Termination

You may stop using the Service at any time. If you have created an account, you may request deletion of your account and associated personal data via the contact form; see our Privacy Policy for how we handle deletion requests.

We may suspend or terminate your access to the free parts of the Service at any time, including if you breach these Terms, use the Service unlawfully, are or become a resident or national of a Restricted Jurisdiction, or if we discontinue the Service.

A paid Builder licence is treated differently. We will not revoke a licence you have paid for except (a) where you materially breach these Terms — in particular by sharing, reselling, or transferring the licence or your account, by copying or reimplementing the Builder (Section 8), or by using the Service unlawfully — or (b) where we are legally or regulatorily required to stop providing the paid features to you. Where we revoke a paid licence for material breach we will tell you the reason; where we must stop for legal or regulatory reasons we will discuss an appropriate remedy with you. Discontinuing the Service, or terminating your access to free features, does not extinguish a paid licence.

On termination, the licences granted to you under Sections 5 and 6 cease. Your rights in Generated Code under Section 8 are unaffected, and Sections 12 (Disclaimer of Warranties), 13 (Limitation of Liability), and 15 (Governing Law) survive.

15. Governing Law

These Terms are governed by the laws of the Republic of Seychelles, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of Seychelles.

If you are a consumer, the above does not deprive you of the protection of any mandatory consumer-protection rules of the country where you are habitually resident, including any right to bring proceedings before your local courts.

16. Copyright Complaints

The free Expert Advisor pool is contributed to by users. We do not write those files and cannot verify who holds the rights to each one before it is published. If material on this site infringes your copyright, email contact@mt5depot.com with "Copyright notice" in the subject line. The same address applies if you believe our own content uses your work without permission.

What a notice must contain

So that we can act without guessing, include all of the following:

1. Identification of the work you say is infringed — a link to the original, a repository, a store listing, or a copy of the file.
2. Identification of the material on mt5depot you want removed, precise enough for us to find it: the page URL and the name of the file or listing.
3. Your name, postal address, telephone number, and email address.
4. A statement that you have a good-faith belief the use is not authorised by the rights holder, its agent, or the law.
5. A statement that the information in your notice is accurate, and that you are the rights holder or authorised to act on the rights holder's behalf.
6. Your physical or electronic signature.

These are the elements set out in section 512(c)(3) of the US Digital Millennium Copyright Act. We ask for them because they are a well-understood standard, not because we assert that US law governs this site — see Jurisdiction below.

What we do with a notice

1. We acknowledge receipt, normally within 5 business days.
2. Where the notice is complete and the material is identifiable, we remove or disable access to it promptly, without waiting for the contributor to reply.
3. We notify the contributor by email at the address given when the file was submitted, tell them what was removed and why, and pass on your notice — including the contact details in it. If you do not want your details passed on, say so and we will consider whether we can act without them.
4. We keep a record of the notice and of the action taken.

Pool submissions are published without attribution unless the contributor asks otherwise (Section 6), so a removal is not an accusation against a named person and does not appear as one on the site.

Counter-notice

If your file was removed and you believe that was a mistake — for example, you are the author, or your use is licensed or permitted — reply to us with a counter-notice containing: identification of the material and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed as a result of a mistake or misidentification; your name, postal address, telephone number, and email address; and your physical or electronic signature.

We forward a valid counter-notice to the person who sent the original notice. Where the dispute is genuinely contested and neither side withdraws, we keep the material offline until the parties resolve it between themselves — we are not in a position to adjudicate a copyright dispute.

Repeat infringers and misuse

We stop accepting submissions from contributors who repeatedly submit infringing material, and we may remove their earlier submissions and terminate their account, applying the rights reserved in Section 6. Equally, a takedown notice removes something from a public library that other traders use: sending one that knowingly misrepresents the position — to remove a competitor's work, for instance — can carry liability for the sender, including for costs incurred by the contributor and by us.

Jurisdiction

We are not a US service provider, do not claim the safe harbour of the US Digital Millennium Copyright Act, and have not designated an agent with the US Copyright Office. We operate this procedure voluntarily because it is a clear, widely recognised way to handle these disputes. Following it does not waive any right or defence available to us, or to you, under any applicable law. This Section describes how we handle copyright complaints; it is not legal advice.

17. Changes to These Terms

We may update these Terms at any time. Material changes will be indicated by an updated effective date. Continued use of the Service constitutes acceptance. The version in force when you purchase a licence governs that purchase.
